(the New Rules governing the legal relationship between clients and architects, engineers and consultants). In addition, Bim&Beyond will retain the full copyright pursuant to article 36, paragraph 1 of SR '97 and Article 46 of DNR.
Digital illustrations
Digital illustrations (i.e. bitmaps) may only be used after written permission for publication purposes without further modifications and/or additions. In the event of publication, Bim&Beyond shall be listed as the author.
Digital drawings
Digital drawings (e.g. AutoCAD files) and data are intended as underlying data to which information can be added. It is not permitted in any manner whatsoever to duplicate, reuse or manipulate these files provided.
Third parties
It is also not permitted to provide the files to third parties, or retain them following completion of the project. Files and/or data modified by you or by third parties (within the limits of the copyright) must contain a marking in order to ensure that the modification and your company name can be identified. It is only permitted to deviate from these conditions with the express written prior consent of Bim&Beyond.
Liability
If the conditions above are not complied with, we will hold you liable for loss of income and/or costs incurred. Regardless of whether we have given permission for distribution, upon acceptance of these digital files you indemnify Bim&Beyond against any damage or loss suffered or claims incurred by you or any third parties.
